Sheriff vs. Judge in Michelle Rodriguez Case

A war of sorts seems to be erupting between the L.A. County Sheriff's Department and some L.A. County judges on the subject of incarcerated celebs.

"Lost" star Michelle Rodriguez was released yesterday, after serving only 10% of her sentence. With a partial last day, that computes to 18 days in the pokey. The judge who sentenced her for a DUI-related probation violation had ordered that she fully serve her 180-day sentence. So why did the Sheriff do it?

Rodriguez's uber-lawyer Shawn Chapman Holley appeared in court yesterday where the judge expressed her displeasure about the plan to release Rodriguez early, but ultimately said the Sheriff controlled the jail. The judge made it clear -- she wanted Michelle in the slammer for her sentence.

But law enforcement sources say the Sheriff felt he had to treat Rodriguez the way he treats every other female inmate. Because of severe overcrowding, the standard is to release everyone after they serve 10% of their time. Even though the judge drew the line in the sand and demanded the full nine yards, the Sheriff felt equality was more important.

We're told the judge knew what the Sheriff was doing before Michelle was sprung. You'll recall the Sheriff had a standoff with the judge in the Paris Hilton case as well. It's the new court craze!

18. Just another case where judges are trying to punish people becasue of who they are....not what they have done. Celebrities punishments should not being any more, or less, than anyone else.

19. The only way to fix this problem is to sentence people for 10x their regular sentence. The early release will then make up the full time they should have served.

23. As long as she was treated the same as everyone else in that jail then this is fair and nobody should complain. Once she surendered to the jail she was the sheriff's to deal with and not the judge. If he really wanted her in jail for a longer period he can do what was done to Paris, call her back into court and send her back to jail. Paris was released for health reasons, thus she could be sent back, she also had served 10 percent of her time so it is obvious that she was not treated the same as other prisoners. I think she was deliberately mis treated by the judge and the sheriff.

I do not think he can, the mandate to reduce the crowding in that jail is a Federal decision and so long as the criteria is the same for all prisoners then Fed trumps State.

The real question here is why are we putting non violent people in jail? is there no other way to deal with them.

28. Another example of people not being punished for their crimes. And people wonder why crime rate gets worse. All we keep hearing about is people being let out of their sentences sometime in hours after they were incarcerated and all due to "overcrowding". If things are so bad, why don't we hear about what the county is doing about it.

29. Uh, yes equality! Why did Paris have to do all her time, any ordinary folk would not have had to do the time that Paris did, the Judge used her to gain fame and noteriety, Michelle did exactley what a normal citizen would have had to do, it is about time the judges stop useing celebrities as an example! Keifer is doing all his time because he chose to do his time in a private city jail, if he were in a county facility he would be out too!

I am looking forward to this writers' strike generating a reality show something like Survivor - Diva Island and put all these near-to-spinning-out celebs in a free-for-all cage match style of entertainment. They say COPS really spawned off the last writers strike ... that'd be too tame nowadays. We want upside down naked celebrity crucifiction! Bring it on!
